The Eastern District of Texas is officially the nation’s most popular patent litigation by far, according to a recent report. And it’s easy to see why. As the study shows, the region’s juries are consistently the most generous when handing out damage awards.
The Eastern District topped the list by taking in 1,425 new patent infringement cases during 2014, according to the report from Lex Machina, a Silicon Valley-based legal analytic firm. And 982 of those cases were filed before U.S. District Judge Rodney Gilstrap of Marshall, making him the nation’s busiest patent jurist, according to the report.
When it comes to damages, the report notes that since 2000, less than 2 percent of all patent infringement cases resulted in compensatory damages, and just a few outlying awards drive the totals. For example, federal juries awarded $1.8 billion in damages during 2014, but the awards were spread out among 68 cases.
The report showed that the Eastern District has the highest ratio of compensatory damages between 2005 and 2014 when compared with the number of cases filed during the same time period. While the national ratio of compensatory damages was $426,108 per case, the Eastern District’s ratio was more than $5 million spread across 6,157 cases.
