In a rush to get an extra bag on his sleigh , Santa ordered Jimmy Elf to lift a bag without the help of other elves. As Jimmy hoisted the bag, he felt a sharp pain in his back and fell forward. As he was falling, Jimmy was nailed in the head by one of Blitzen’s hooves, who was already airborne .

Santa failed to notice the fallen elf and Jimmy was rushed to Claus Community Hospital. Jimmy was diagnosed with a mild concussion. The MRI revealed a slightly bulging disc, which the ortho-elf attributed to the fact that Jimmy was 375 years old. Jimmy was given a script for candy apples and jelly beans, told to stay in bed for five days, and cleared to go back to work in 5 days.

Jimmy returned to work on December 30 but advised his supervisor he was in too much pain. Jimmy was reassigned to light duty answering Letters to Santa Claus, Jimmy, ticked off that Santa still had not checked on his well being , wrote nasty letters back to the little children. In one letter, Jimmy wrote “Santa is a bit creepy in that red suit and he enjoys a good scotch more than milk and cookies.” In another letter, Jimmy warned little Susie to keep her burglar alarm on on Christmas Eve.

Because writing letters was a pain, Jimmy filed an elfin compensation claim. A week after Jimmy’s claim was filed, Santa was advised of the bitter letters that Jimmy had written to the children.

Santa called Jimmy into his workshop and told Jimmy ” You’re fired. You’ll never work in the Pole again! Good luck! Maybe you will find a job at Keebler .”

Angry, rejected, and hurt, Jimmy saw an ad for Dickie Grigg, the lawyer who demands justice for downtrodden elves. Dickie filed suit on Jimmy’s behalf against Santa and Polar Enterprises for elfin comp retaliation, seeking one million candy canes and an unspecified amount of punitive damages .

Santa’ defense lawyer filed a response alleging insubordination and malingering by Jimmy as legitimate non-pretextual basis for the termination and that Jimmy failed to mitigate his damages .

The Elfin District Court immediately ordered Santa and Jimmy to mediation, hoping that the mediators would work their magic and restore Christmas spirit to the North Pole!
