Can the Eastern District of Texas’ enormous patent docket get any bigger?
It’s a reasonable question to ask after the district that’s long been popular with plaintiffs shattered an all-time record in 2015, when 2,591 new cases landed on its docket—a huge number that constitutes nearly half of all new patent filings in the nation.
The Eastern District famously attracts plaintiffs because of its reputation for friendly juries and experienced judges willing to hear their cases—especially in the Marshall and Tyler Divisions. And its patent docket has soared since 2011, when Congress passed the America Invents Act (AIA), which forces plaintiffs to file individual cases against defendants instead of suing multiple parties at one time.
But the 2015 filings also represented a big spike for the Eastern District—an increase of more than 1,000 new cases from the previous year.
