Mediation Fee Schedule
Mediation fees are generally quoted case-by-case and vary according to the number of parties, amount in controversy, and nature of the dispute. Some examples include:
Full-Day Mediation – flat fee of $1,000 per party
This fee covers the cost of a full-day mediation session, time spent reading pre-mediation submissions, a limited number of post-mediation telephone conferences, scheduling and administration of the mediation session, and lunch during the session.
Half-Day Mediation – flat fee of $600 per party
A half-day mediation lasts up to four hours. Each hour after the fourth hour is billed at a rate of $275 per hour, divided equally by the parties.
Pre-Suit Mediation – flat fee of $500 per party
Many pre-litigation disputes can be resolved in a three-hour mediation conference. For those matters in which a resolution is not reached in three hours, but progress is made, you would have the option of scheduling a second three-hour session at the same rate.
“Rocket Docket” Mediation – flat fee of $350 per party
The Rocket Docket Program is designed to provide an alternative means of resolving those disputes with lower amounts in controversy, which were once referred to settlement week for mediation. For those cases that meet the Rocket Docket Profile, we offer a three-hour mediation session at a reduced rate of $350 per party. The submission will be simplified, and the mediation position submissions may be made via e-mail or fax. Parties with multiple cases may schedule up to three different cases on the same day in order to maximize the benefits of the Rocket Docket Program.
Deal Mediation
The same skills that resolve conflicts help parties reach efficient and durable deals on the front end. There is also a lot of benefit in having a third-party help work through differing terms so that the people working together on the venture post-deal are not associated with reconciling the competing terms. Don does consulting work with deal negotiators at Full-Day or hourly rates.
Travel Expenses
If the mediation session occurs outside San Antonio, all travel expenses (air fare, meals, lodging, ground transportation, etc.) are divided equally among the parties. There is no charge for travel time. Parties receive an expense invoice shortly after the mediation session.
Follow-Up Calls and Correspondence
For cases in which progress is made, but the dispute is not resolved at the session, there is no charge for the first hour of post-session follow-up calls and written correspondence. Should the parties request additional follow-up after the first hour, each hour is billed at a rate of $275 per hour and divided equally by the parties.
Holding Dates
A party may hold a mediation date. Such holds will be honored for forty-eight (48) hours. Should the date not be confirmed within 48 hours, the requested date may be given to other parties requesting it.
Payment
Payment is due before or on the day of the mediation session. Checks should be made payable to Donald R. Philbin, Jr., P.C. The tax identification number is 74-2800147 and a W-9 is attached.
